WIFE of the immediate past Chairman of Oshimili South Local Government Council, Mrs Uche. MaryRose Ezenyili has instituted a legal action seeking for the dissolution of her three-year old marriage with her husband, Dr Obi Kelvin Ezenyili, who was the immediate Council Chairman in Oshimili South.
The petitioner, in suit marked UDCC/ 6/2024 filed before the Customary Court of Nigeria Ubulu-Okiti District Holden at Ubulu-Okiti is seeking for the following orders:
* An Order dissolving the marriage between the Petitioner and the Respondent contracted on 18th December 2020 under Igbo Native law and custom as the marriage has broken down irinretrievably.
*An Order granting custody of the child of the marriage to the Petitioner.
*An Order of this honourable Court granting leave to the Petitioner to refund the bride price/dowry of ten thousand Naira (N10,000) to the Respondent through the Registry of this honourable Court.
The Petitioner aged 27, filed four Grounds for the dissolution of the marriage to wit:
*That the marriage has broken down irinretrievably and the Petitioner can no longer live together with the Respondent as husband and wife anymore.
*The Petitioner has lived apart with the Respondent for over two years
*The Respondent is cruel and the Petitioner finds it intolerable to live with him as husband and wife.
*The Petitioner and the Respondent are incompatible as there is lack of love between them and the Petitioner finds it intolerable to live with him.
However, the Respondent aged 39, in a Cross-petition filed prayed the court to save his marriage saying that he is opposed to grant of the dissolution of the marriage.
According to him, “the Cross Petitioner (ex Oshimili South local government Chairman) and the Petitioner (Wife) are under the same roof until the Petitioner’s mother came into the marriage and started dictating how the marriage of the Cross Petitioner and the Petitioner should be run”.
The case has been adjourned to the 14th of May 2024 for further hearing after the initial mention on the 30th of April 2024.
